Definition of a Foreigner

Yes. Foreigners can buy an apartment in Poland, but there are certain conditions to be fulfilled and restrictions related to citizenship and residence status in the country.

3) Purchase of real estate by a foreigner who has been residing in Poland for 5 years.

4) Purchase of real estate by a foreigner who is the spouse of a Polish citizen and has resided in Poland for 2 years.

5) Acquisition of real estate by inheritance when the seller has owned or used the property for 5 years.

6) Acquisition of real estate for statutory purposes with an area of up to 0.4 hectares by persons listed in Article 1 Section 2 point 4.

7) Acquisition of real estate by a foreign bank after an unsuccessful auction.

8) Acquisition of shares by a bank due to the bank’s requirements.

  • on condition of the foreigner’s stay in Poland for more than 5 years from the date of obtaining a residence permit;
  • on condition of marriage with a Polish citizen/citizen and residence in Poland for more than 2 years (the real estate will be common property of the spouses);
  • obtaining real estate in Poland; if married to a Polish citizen and residing in Poland for more than 2 years (the real estate will be jointly owned by the spouses).

In such situations, foreigners are granted the right to buy an apartment in Poland without restrictions, as it helps to attract investment, contributes to the development of the real estate market and the economy of the country as a whole.

The exception is the purchase of real estate in the border area, as in the vast majority of cases a permit is required to purchase such real estate.
