Main types of rental agreements:

  1. Traditional or ordinary agreement. This is the most common type of agreement in Poland, regulated by the Civil Code, and it maximally protects the tenant’s rights while offering less protection to the property owner. Specifically, the owner cannot unilaterally increase the rent.

    This agreement can be concluded for a definite or indefinite period. Its early termination is possible only by mutual agreement of the parties or in situations provided by law. In case of forced eviction, the tenant must be provided with social temporary housing. If an indefinite agreement is concluded, it remains valid until one of the parties wishes to terminate it. At the same time, the intention to terminate must be communicated to the other party in advance. The agreement is concluded in written form without notarization. The tenant can be a natural or legal person.

  2. Umowa najmu okazjonalnego (Occasional rental agreement). This type of agreement protects the owner’s interests more than a standard agreement. It is primarily used for short-term agreements up to 10 years and for agreements with foreigners. Since this agreement simplifies the eviction of tenants, it is advisable to seek professional help.     Key features of najem okazjonalny:
  • Concluded only for a fixed term (maximum 10 years).
  • The tenant undertakes to voluntarily vacate the premises after the lease term expires – this is confirmed by a separate notarial document.
  • It is mandatory to specify an alternative address where the tenant can move in case of eviction (exceptions are made for persons with UKR status and citizens of Ukraine who arrived in Poland after February 24, 2022). Legal basis: Simplified conditions for concluding an occasional residential lease agreement by citizens of Ukraine, Art. 69 of the Act of March 12, 2022, on assistance to citizens of Ukraine in connection with the armed conflict on the territory of that state, aims to facilitate the conclusion of lease agreements with citizens of Ukraine seeking refuge in Poland.
  • The apartment owner must notify the tax office about the conclusion of the agreement within 14 days.
  1. Institutional agreement. This is a type of occasional agreement where the landlord can only be a private entrepreneur, not a natural person. It is concluded for a specific period and requires notarization. In this case, no guarantee from the owner of other housing is provided for the tenant to be evicted to in case of non-performance of the agreement.

In Poland, you can also conclude a sublease agreement, where the tenant offers partially or fully rented housing to another person with the owner’s consent, a gratuitous loan agreement, and a social housing agreement for specific categories of the population.

Any real estate agency in Poland will confirm that a “kaucja” (deposit) is a common practice when concluding a rental agreement for residential or commercial property.

“Kaucja” (from the Polish word kaucja) – is a deposit that the owner receives from the tenant as a guarantee that the property will remain intact and undamaged. That is, it is a certain sum that serves as insurance and is returned to the tenant after the end of the agreement, provided there are no rental arrears, damaged furniture, or appliances.

The maximum amounts of “kaucja” are set by law and cannot exceed the rent amount for more than 12 months. However, it is not mandatory. This means that if the owner agrees, a rental agreement can be concluded without a deposit. But if the owner takes a “kaucja,” the corresponding clause must be included in the agreement to then have the right to get these funds back, moreover, with indexation.

Typically, the amount of the “kaucja” is equivalent to one month’s rent, but owners may set other amounts. For example, they might charge more money if tenants move in with children or pets.

The maximum “kaucja” for a long-term agreement is up to 12 months’ rent, and for a short-term agreement, up to 6 months’ rent.

The deposit is returned within 30 days from the day of moving out of the apartment or other property.
